Poor judicial enforcement has been constantly identified in transitional markets as one of the main impediments of shareholders' protection and foreign direct investments. We can also observe the growing need for corporations to have a strong corporate governance framework in the wake of recent high profile corporate scandals. The modern framework more and more often suggests incorporating mediation into it. As a result, ADR (Alternative Dispute Resolution) is becoming the preferred method of dispute resolution. ADR has many advantages over litigation, including privacy, more efficient decision making and avoiding lengthy court litigations. Taking ADR there gives time to consider all dimensions of the dispute, while the adjudicative process only considers a case's legal dimension. Because of ADR's broader view on disputes, such a decision is more likely to be perceived as fair by all parties.
